Apex Site Defense Terms of Service

Last updated: 9/27/2026

These Terms of Service (“Terms”) govern the services provided by Apex Site Defense (“we,” “us,” or “our”) to you (“you,” “the Client”). By purchasing or using our services, you  agree to these Terms.

  1. Services

Apex Site Defense provides WordPress website security services, which may include  security monitoring, software updates, malware scanning, backups, security hardening,  vulnerability alerts, hacked-site cleanup, and related work, as described in the plan or  service you purchase. The specific services included depend on the plan you select. We  may adjust the tools and methods we use to deliver these services as security best  practices evolve.

  1. Not a guarantee of absolute security

No person or company can guarantee that a website will never be hacked, go offline, or  suffer a security incident. Security reduces risk; it does not eliminate it. We use  commercially reasonable methods and industry-standard tools to protect your site, but  we do not warrant or guarantee that your website will be completely secure, error-free,  or immune from all attacks, malware, downtime, or data loss. You acknowledge and  accept this.

  1. Your responsibilities

To let us do our work, you agree to:

Provide accurate account information and the access we need (such as WordPress administrator access and, where required, hosting or SFTP access).

Confirm that you own the website, or are authorized to request security work on it, before we begin.

Keep your own copies of important data where practical, and keep your login credentials secure.

Pay for and maintain your own hosting, domain, and any third-party software licenses (such as premium plugins and themes), unless we agree otherwise in writing. Respond within a reasonable time when we need information or a decision from you.

You are responsible for the content on your website and for ensuring it complies with  applicable laws.

  1. Access and authorization

You authorize us to access, modify, update, and where necessary remove files, plugins,  themes, database entries, and settings on your website as reasonably required to  perform the services. We perform security testing or scanning only on websites you own  or have authorized us to work on. We do not test or scan third-party systems (such as  your hosting provider’s infrastructure) without proper authorization.

  1. Fees and payment

Fees are as stated for the plan or service you purchase. Recurring plans are billed [monthly / annually] in advance and renew automatically until cancelled. One-time  services (such as hacked-site cleanup) are billed as quoted. All fees are non-refundable  except as required by law or as expressly stated. We may change our prices with  reasonable notice; changes take effect at your next renewal.

  1. Cancellation

You may cancel a recurring plan at any time, effective at the end of your current billing  period. We do not provide partial refunds for the current period. On cancellation, we will  provide your most recent backup on request, and our ongoing responsibility for your  site’s security ends.

  1. Third-party services and software

Our services rely on third-party software and services, including WordPress, plugins,  themes, hosting providers, and security data sources. We are not responsible for the acts,  omissions, availability, or security failures of these third parties, or for issues caused by  software we did not install or by changes made by you or others.

  1. Hacked-site cleanup

Where you purchase cleanup of a compromised site, we use commercially reasonable  efforts to identify and remove malware, close the entry point where we can identify it,  and help you request removal from blocklists. Because attackers hide their work and  reinfection can occur, we cannot guarantee that all malicious code will be found, that a  site will not be reinfected, or that any blocklist or search-engine review will succeed.  Cleanup does not include recovery of data that was already lost or corrupted before our  work began.

  1. Limitation of liability

To the fullest extent permitted by law, Apex Site Defense will not be liable for any indirect,  incidental, special, consequential, or punitive damages, or for any loss of profits, revenue,  data, goodwill, or business, arising out of or related to the services, even if we have been  advised of the possibility of such damages. Our total liability for any claim arising out of or  related to the services will not exceed the amount you paid us for the services in the thirty days before the event giving rise to the claim. Some jurisdictions do not allow  certain limitations, so some of these may not apply to you.

  1. Indemnification

You agree to indemnify and hold harmless Apex Site Defense from any claims, damages,  losses, or expenses (including reasonable legal fees) arising from your use of the services,  your website’s content, your breach of these Terms, or your violation of any law or third party right.

  1. Confidentiality

We treat your access credentials and non-public information about your site as  confidential and use them only to provide the services. We may retain records (such as  reports and backups) as needed to provide the services and as described in our Privacy  Policy.

  1. Termination by us

We may suspend or end services if you fail to pay, if you use the services unlawfully, if you  ask us to do something we reasonably believe is illegal or unethical, or if continuing would  create an unreasonable risk. Where practical, we will give you notice.

  1. Changes to these Terms

We may update these Terms from time to time. The updated version takes effect when  posted, with the “Last updated” date revised. Your continued use of the services after  changes means you accept them.

  1. Governing law

These Terms are governed by the laws of Delaware, United States, without regard to its  conflict-of-laws rules. Any dispute will be handled in the courts of Delaware, United  States.
